Terms of Use
1. The service
Naya360 ("we") lets brands and fashion houses create fashion images with artificial intelligence: creating models, fitting, and scenes. The service is in beta and may change. Using it means you accept these terms.
2. Account
An account is opened by the business owner, who can invite more users according to the plan. You are responsible for keeping your sign-in details safe and for every action in the account. You must give accurate details and use an email address you control.
3. Subscription, credits and payment
- Every image you create uses credits from your balance. Your balance is shown in your profile.
- The subscription is monthly and renews every month on the day you signed up (in a shorter month: on its last day). The monthly credits included in your plan are valid until the end of that cycle. Credits bought separately are valid for 12 months from the day of purchase. Credits that expire first are used first.
- Upgrading your plan or buying an add-on (a user or a brand) takes effect immediately, charged pro rata until the end of the cycle. Downgrading your plan or removing an add-on takes effect from the next cycle.
- Credit top-ups are available to an active, paid subscription. The intro pack is available once per account, including during the trial.
- Credits cannot be transferred between accounts.
- A generation that fails or is blocked by the AI provider is not charged.
- We may update prices and plans. We will notify you by email in advance of a change to the subscription price, and it will apply from the cycle after the notice. A change will not apply to credits already paid for.
4. Cancellation and refunds
- You can cancel your subscription at any time. Cancellation is immediate, and the credits of the current cycle remain available until it ends.
- If you cancel a purchase (a subscription or a credit top-up) within 14 days of payment, we will refund the amount paid minus the value of the credits used from that purchase, at the credit price of that purchase. The unused credits will be cancelled. To cancel, contact us by email.
- After 14 days from payment there is no refund, unless the law requires otherwise. The intro pack cannot be cancelled by yourself; for a special request, contact us.
- A double or incorrect charge will be refunded in full.
5. Failed payment
- If the monthly charge fails, we will notify you by email. Until the payment goes through, no monthly credits are added and you cannot top up credits; credits bought in a top-up keep working. We will try to charge again and send reminders.
- If payment is not received within 30 days, the account will be frozen and the subscription cancelled. Credits bought in a top-up are kept until they expire. To reactivate the account, contact us.
6. Keeping images and files
The images and files in an account are kept as long as the account is in use. If an account has no active subscription (after a cancellation, a freeze, or a trial that did not become a subscription) and no image has been created in it for 90 days, its files will be deleted. We will send an email notice 7 days before the deletion. We recommend downloading any images you want to keep.
6a. Support
When you ask us for support and approve it, we may view the outputs, reference images and settings of your account only to investigate the issue. The access is read-only, logged, and can be revoked at any time. Without your approval we do not view the content of the account.
7. Your content
You keep the rights to the content you upload. You grant us a limited license to process it in order to run the service for you. You confirm that you have the right to upload any content, and that you have the consent of every person shown in it. Images of minors may be uploaded only with the approval of a parent or guardian. You are responsible for how you use the outputs.
8. Prohibited use
- Uploading content that is illegal, offensive, or infringes the rights of a third party, including a person's likeness without their consent.
- Creating sexual or misleading content, or content that shows minors inappropriately.
- Trying to bypass limits, security or the credit system, or to harm the availability of the service.
- Giving access to a person outside the account, or reselling the service without consent.
We may suspend an account that breaches these terms.
9. AI outputs
Images are created automatically and may include inaccuracies or differences from the original garment. You must check every image before commercial use. We do not guarantee that an output will be unique or free of resemblance to existing content.
10. Availability and liability
The service is provided as is, without a guarantee of continuous availability or of being error-free. To the maximum extent permitted by law, our liability is limited to the amount you paid in the three months before the event, and we are not liable for indirect damages.
11. Termination
You can close your account at any time by contacting us. We may stop or suspend the service in case of a breach. Provisions that by their nature continue (ownership, liability) remain in force.
12. Changes and governing law
We will update these terms from time to time, and we will notify you by email of a material change. These terms are governed by Israeli law, and the competent courts in Israel have jurisdiction.
